In particular, newer developments often utilize standard contracts calling for the use of specific materials, layout, finishing, and other provisions regarding the design and construction of a home. These contractual requirements typically mirror those of the model home used to entice purchasers to buy a newly constructed property from an Edward R. James Company. However, when actual construction of the home proceeds, the homebuilder (a subsidiary or affiliate of Edward J. James) may use lesser quality or cheaper materials and modify the plan specifications to lower the costs of installation and construction. These shortcuts can deprive home purchasers of their contractual rights to a home consistent with their expectations, the contract, and the model home.
